We have received a request from property 243MR-301 Powderhorn Drive to construct a shed/garage in front of their home due to physical limitations on your property.
Masthope Architectural Guidelines require: accessory structures shall not be placed in front of homes. The plans indicate the shed/garage will be placed in the front yard.
We have received a request from property 847RM-146 Candlewick Way to construct a garage exceeding height restrictions.
- Masthope Mountain Property Owners Handbook require: No storage or accessory structures shall exceed eighteen (18) feet in height.
We have received a request from a property owner to leave a trailer in front of their house located 124 Twin Rivers Road. Masthope Mountain Community Handbook states:
17. No structure of a temporary character, trailer, tent, shack, barn, garage or other outbuilding shall be used on any lot at any time, either temporarily or permanently, including mobile homes or recreational vehicles or camping trailers as defined by federal and state rules and regulations.
The Governing Covenants states:
9. Vehicles, Trailers, and Water Craft.
No camper, trailer, water craft or unlicensed or inoperable motor vehicle may be kept or parked on any lot except in an enclosed garage or any attractively screened enclosure of landscaping which complies with the screening requirements set forth in Section V, Restrictive Covenant No. 12 hereinafter ser forth, so that any such property will not be visible as therein provided. Motor vehicles as sued herein shall include, but shall not be limited to, automobiles, trucks, snowmobiles, motorcycles, trail bikes, and off road motorized equipment. No motor vehicles shall be parked on the improved road surface and shoulder of any private road in the Development, whether or not said vehicle is in functional order. The Declarant shall have an unrestricted right to remove said vehicles and other such equipment parked of kept in violation of this covenant. The Declarant may delegate this duty to the Committee. The Grantee(s), their heirs and assigns, shall reimburse Declarant, its successors and assigns, for any and all expenses incurred incurred by the Declarant, its successors and assigns, in the removal of vehicles parked in violation of this covenant. The Grantee(s), their heirs and assigns, hereby release, remise, discharge and hold harmless Declarant, its successors and assigns, and any agent, servant or employee of the Declarant from any and all liability for or arising from any such removal of vehicles. However, nevertheless, minibikes, trail bikes, snowmobiles and other similar type vehicles may be permitted, subject to these restrictions, within the Development if licensed by the Declarant, or if such duty has been delegated to the Committee, but the Committee, or otherwise expressly authorized by the rules and regulations established by the Declarant or the Committee.
It is the policy of the Board of Directors to notify adjacent property owners via certified mail, and the weekly messages and community website for all variance requests made to the ECC.
